Your agreement with ElseBranch

These Terms are a binding agreement between you and ElseBranch Inc. ("ElseBranch"), operator of HardBeet. Before signing in or requesting a sign-in code, HardBeet provides links to these Terms and the Privacy Policy. Signing in or requesting a code may create or access a provisional authentication record, but it does not activate check-in sharing. By selecting the legal-agreement checkbox and continuing through the consent screen, you agree to these Terms. If you do not agree, do not continue to the check-in service; you may request deletion of a provisional account.

You must be at least 18 years old and legally able to enter this agreement. If you use HardBeet on behalf of an organization, you represent that you have authority to bind that organization.

What HardBeet is

HardBeet is a daily check-in aid built around an agreement between independent loved ones. It helps a person share whether and when they checked in today with people they approve, without device location.

HardBeet is not an emergency response service, medical monitoring service, location tracker, substitute for calling emergency services or a caregiver, or proof that someone is safe. If someone may need urgent help, contact local emergency services or another appropriate real-world support channel.

Consent and sharing

HardBeet is built around consent. Create sharing agreements only with people you know and trust. When you share your check-in status, approved loved ones may see whether and when you checked in, your reminder and follower-alert timing while sharing is active, pause state, and suggested next steps. Your email address, phone number, and sign-in provider are used for account access and are not shown to approved connections through HardBeet. HardBeet does not request location permission or receive device location. Approved loved ones cannot see supporting signals, private phone activity, messages, apps, photos, browser history, or health details through HardBeet.

I share with them and They share with me are separate permissions. Either person may stop one direction without automatically changing the other. Canceling an unused invite code does not end an accepted connection.

The person sharing in each direction controls that direction. They can pause it for 24 hours or 7 days, resume it, or stop it without changing other agreements or the other person's separate sharing direction. HardBeet may keep an authorization record showing the statement version, language, and confirmation time. Older connections may require confirmation of the current statement before coordination features become available.

You are responsible for inviting the intended person and for pausing, ending, or declining sharing when appropriate.

Reach-out coordination

After the one-hour grace period for an eligible missed check-in, one approved follower may indicate that they plan to reach out. The plan lasts no more than 30 minutes. Other currently eligible approved followers see only that another approved follower has a plan and when it expires, not who created it. Only the creator can withdraw the plan.

A plan records temporary intent only. It does not mean anyone was contacted, received or answered a message, resolved the missed check-in, or is safe. Followers cannot create another person's check-in, mark another person safe, or record an outreach result in HardBeet. Only that person's own tap on I'm here today creates a daily check-in.

HardBeet may offer generic pre-filled text through the operating system's share menu. The selected app controls editing and sending. HardBeet does not receive or store the recipient, edited or sent message, delivery status, reply, resolution, or safety outcome.

Reminders and alerts

HardBeet attempts to send push notifications for reminders and approved loved-one alerts. When sharing is active and no manual check-in was recorded, follower alerts become eligible 60 minutes after the person's chosen daily time. Delivery is best effort and may be delayed, blocked, silenced, held until morning, retried, or not delivered because of recipient settings, network conditions, operating-system behavior, service outages, or provider issues.

A failed reminder to the person does not create a check-in and does not cancel the backend's attempt to notify eligible followers. Each follower needs notifications available on their own device to receive a push alert.

Do not rely on HardBeet notifications for emergencies, medical decisions, or time-sensitive safety decisions.

Supporting signals

Only tapping I'm here today creates a daily check-in. The new release no longer collects app-open, motion, battery, or background-task supporting signals. Older app versions may still send private diagnostics until updated. These signals do not create a check-in, change loved-one status, or appear to approved loved ones. They do not prove that a person is safe, awake, responsive, or physically near their phone.

When a network connection is unavailable, HardBeet may save a pending check-in on the user's phone and retry delivery. A pending check-in is not visible to approved loved ones until the backend confirms it.

HardBeet does not guarantee continuous background execution. iOS, Android, device settings, battery mode, force-quit behavior, and network access can limit background updates.

License and user responsibilities

ElseBranch gives you a personal, limited, revocable, non-exclusive, non-transferable license to use HardBeet for its intended purpose, subject to these Terms and applicable store rules.

Account access

HardBeet may use email OTP, email and password for accounts configured with one, Apple, Google, or phone OTP for sign-in. Available methods can vary by country, account, and provider readiness. You are responsible for maintaining access to the email, phone, password, provider account, and device used to sign in.

Third-party services

HardBeet depends on services supplied by Supabase, Expo, Apple, Google, app stores, network providers, and device operating systems. Their own terms and privacy practices may apply. We are not responsible for third-party services outside our control, but we remain responsible for our own obligations under applicable law.

Account deletion

You may stop using HardBeet at any time. Delete an account in Settings > Privacy and account > Delete account, or use the public deletion page. Deletion ends sharing and removes personal data as described in the Privacy Policy, subject to limited lawful retention.

Request account deletion

Availability and changes

HardBeet is provided on a best-effort basis. The service may change, pause, or stop, and may be unavailable during maintenance, outages, network failures, provider disruptions, or platform changes. We may modify features when reasonably necessary to improve, secure, or operate the service.

No professional advice

HardBeet does not provide medical, legal, caregiving, security, or emergency advice. App content, status displays, and notifications are informational only.

Suspension and termination

We may suspend or terminate access if a user materially violates these Terms, compromises another person's privacy, misuses the service, or creates a security or legal risk. Where reasonable, we will provide notice and an opportunity to address the issue.

Ownership

ElseBranch and its licensors own HardBeet, including its software, branding, and content, except for rights expressly granted in these Terms. These Terms do not transfer ownership to you.

Changes to these Terms

We may update these Terms as the product or law changes. If a change is material, we will provide notice appropriate to the change and ask for renewed acceptance when required. The updated Terms will state their effective date.

General terms

If a provision of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; ElseBranch may assign them as part of a merger, reorganization, financing, or sale of the service, subject to applicable law. These Terms and documents expressly incorporated into them form the entire agreement about HardBeet and replace prior agreements on the same subject.

Mandatory consumer and privacy rights in your jurisdiction remain unaffected. Before filing a formal dispute, contact legal@elsebranch.com so the parties can try to resolve it informally.
